Indefinite Leave to Remain and UK Citizenship
Indefinite leave to remain UK allows people who are not British citizen to settle in the UK indefinitely. Once you have been given the ILR, you are allowed to go and come as you please, though if you are away for more than 2 years you may have difficulty in being readmitted again. To obtain ILR you should pass the knowledge of life in the UK test and meet good character requirements.
The following are visas which shows how long you can stay in the UK to be granted an indefinite leave to remain UK
• Married/unmarried after 2 years
• Ancestry after 5 years
• Highly skilled migrant programme after 5 years
• Work permit after 5 years
• EU nationals and their dependants after 5 years
• If you have been living in the UK lawfully for 10 years
• Unlawful stay after 14 years
• Sole representative of overseas company, religion after 5 years
Indefinite leave to remain UK gives you the right to work or the right to rely on public assistance. Dependants are mostly eligible to apply for settlement at the same time as the principle applicant provided you have lived together in the UK for not less than 2 years. The benefit of ILR is that children born to a parent settled in the UK are British citizens by birth and children born before the parent is settled can get registered as British citizen as soon as one of the parent acquire settled status.
You may qualify as a UK citizenship after being granted indefinite leave to remain, through registration or through the right of abode in the UK. To apply for UK citizenship you must be 18 years old and have been in Britain for at least 3 years and must have held ILR and be married to a UK citizen, have not spent more than 270 days outside the UK in the last 3 years and no more than 90 days in the last 1 year and be able to speak English.
If you have been in the UK for 5 year and you want to obtain UK citizenship then you must:
Have held ILR and be married to a UK citizen
Have held ILR in the UK for at least 1 year
Have held a UK marriage Visa or unmarried partner visa (De Facto) for at least two years
Have not spent more than 450 days outside the UK in the last five years and no more than 90 days in the last 12 months
The applicant must be able to speak English
