E3 Visa and Study in USA

E3 visa is a visa category only for Australian citizens coming to the United States to work temporary in a specialty occupation job that has been offered by a US employer. To qualify for an e3 visa you must have a temporary job and you are required to meet health and character requirements. E3 visa is valid for 2 years and extensions may be granted. The visa allows you to live and work in the United States. Spouses and dependant children under 21 years of age may apply to join their spouse In the United States. Children are allowed to study in the United States and accompanying spouses may undertake employment with an approved employment authorization.

You need to have a job offer from the US before you apply for E3 visa and you cannot apply for an E3 visa from within the US through a change of status. You must apply at a US consulate abroad, either in Australia or another jurisdiction. The validity of the visa should not exceed the validity period of the Labour condition application. There is a maximum of 10,500 visas issued annually which runs from 1st October to 30 September and spouses and children of applicants do not count against the quota.
