If you are pulled over by a police official to give a breath test, then you have every right to refuse it. But you need to know that refusing to a test of such a kind might result into several consequences. Refusing breath test can bring in several charges against you, thus ending you up for trial at court.

Refusing breath test- is it possible?

When you had first applied for car licence, you had to fill in a form, thus agreeing to produce the proof of licence or the licence itself so that you might later agree upon sobriety test, urine test, blood test and breath test. This is actually referred to as ‘implied consent’, thus making it possible for your licence to get automatically suspended on refusal of breath test. You might also be arrested for it. Though, you have the right to refuse breath test, but you need to be aware of the dire consequences.

During breath test, you are requested by the police official to blow into a machine, which uses a kind of blood-alcohol content (BAC) test through infrared light so that the percentage of alcohol content in your blood is quickly determined.

If the test is not properly administered, then BAC results will be inaccurate leading to various DUI charges. Remember, a person might not intake alcohol, but it might show content of it. This is due to consumption of sugar content alcohol, which brings in fall notifications. Though, it is eventually your decision to give into the breath test, but is best to comply with the police official in a very clam manner. Remember, while the test is conducted upon you, try not to say or do anything that might go against you in the court of law.
