Employers Liability Tracing Office - What is it?
Author: bondy12 | Posted: 03.05.2012ELTO is The Employers' Liability Tracing Office which is a new way of keeping track of where people have their Employers Liability Insurance so that in the event of a claim happening many years down the line, theoretically, a company could look on this list and using the time when the insurance was in force or when the incident occurred that has lead to the claim the information can be found so the claim is made against the correct insurer.
In the past there was a law that stated that all people with this type of insurance must keep their certificates for 40 years which was almost impossible for people to do, they could easily get lost as it was just a sheet of paper and we didn’t have electronic ways of storing them such as computers, with the invention of the Tracing Office it will all go into a central database which can then be searched through to discover who was insuring which companies at any time from April 2011 onwards.
Employers Liability Insurance is compulsory by law and covers against any injury or becomes ill as a result of the work that they do. This would cover the Employer against a claim made by an employee who would look for compensation in these circumstances if there were able to hold the employer liable for their injuries as it would obviously not cover it if the employee was to get injured due to their own fault.
If you get a policy from now on you will be asked to give your ERN number (Employers Reference Number) which will then go into the database along with the insurance company and date of the insurance policy so that all of them can be tracked back. This will be especially useful in cases where the employee may become ill later on in life and wish to make a claim against their employer.
There are certain businesses that are not required to have Employers Liability Insurance. For example if you have no employees, or are a family business and all employees are closely related to you, then you may not be required to have the cover. However in any other circumstances you will be required to get this and if you are found not to have it a heavy penalty fine may be imposed upon you and in extreme circumstances you could even not be allowed to have a company anymore.
